Phillips Preiss’ services have provided the basis for fair and equitable valuation of property, resulting in voluntary settlement between “taking” agencies and property owners; or where litigation has ensued, have provided the courts with a basis for informed rulings on value.
The statutory obligations for public agencies who displace residents and businesses as a result of the implementation of public projects are specified in the federal Uniform Relocation and Real Property Acquisition Policies Act of 1970 and Title 49 Code of Federal Regulations, Part 24; Uniform Relocation Assistance and Real Property Acquisition for Federal and Federally Assisted Programs (49 CFR Part 24); and in New Jersey, the Relocation Assistance Law, N.J.S.A. 52:31B-1 et seq., Relocation Assistance Act, N.J.S.A. 20:4-1 et seq., and Regulations for the Provision of Relocation Assistance, N.J.A.C. 5:11-1 et. seq.
Phillips Preiss provides full management and execution of the relocation process in compliance with these laws—including preparation of Workable Relocation Assistance Plans (WRAPs), required in New Jersey for submission and approval of the New Jersey Department of Community Affairs (NJDCA); and under both the federal and State statutes, the management of the relocation process itself, entailing assistance to displacees in obtaining replacement locations and assistance with the relocation process, the evaluation of benefit claims and preparation benefit recommendations to the displacing agency, and the overall management of benefit payment and certification process.
